Sojourn Terms of Service

These Terms of Service ("Terms") govern your use of the Sojourn app (distributed on the App Store as "Sojourn Atlas"), a tax-residency and travel-day tracker. Please read them carefully. They form an agreement between you and Sacha Allard, the operator of Sojourn ("we," "us," or "Sojourn").


1. Acceptance of these Terms

By downloading, installing, or using Sojourn, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the app. If you use Sojourn on behalf of someone else, you confirm you are authorized to accept these Terms for them.

You must be old enough to form a binding contract and to consent to data processing under the laws of your country. If you are not, please do not use Sojourn.


2. The service, and an important disclaimer

Sojourn helps you track where you spend your days and counts those days against travel and residency rules (for example, the Schengen 90/180 window or the UK Statutory Residence Test). It is a tool to help you stay organized and aware.

3. Your data and your account

Sojourn has no accounts and no login. Your travel data lives on your device and in your own iCloud account, which you control. We do not run a database of your personal travel information. How your data is handled is described in our Privacy Policy. You are responsible for keeping your device and your Apple ID secure, and for keeping your own backups through iCloud.


4. Subscriptions, billing, and the free week

Sojourn is free for your first 7 days. After that, some features may require an optional Pro subscription.

We may change subscription prices or plans in the future. If we do, the change will not affect your current paid period, and Apple will notify you of price changes in line with App Store rules, giving you the chance to cancel before the new price takes effect.

6. Accuracy and "as is" (no warranty)

Sojourn is provided "as is" and "as available," without warranties of any kind, whether express or implied, to the fullest extent permitted by law. This includes, without limitation, any implied warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement.

We do not warrant that:

Rule packs, visa data, and flight information may lag behind changes in the law, in airline schedules, or in official requirements. You must verify anything important with the relevant authority or a qualified professional. Some jurisdictions do not allow the exclusion of certain warranties, so some of the above may not apply to you. Nothing in these Terms limits any rights you have as a consumer that cannot be waived under applicable law.


7. Limitation of liability

To the fullest extent permitted by law, neither Sojourn nor Sacha Allard accepts any liability to you arising out of or related to your use of, or inability to use, the app. This includes, without limitation, any indirect, incidental, special, consequential, or punitive damages, and any loss of data, profits, savings, or goodwill. It also includes, without limitation, any tax penalties, interest, assessments, fines, denied entry, overstays, or other consequences arising from reliance on the app's outputs. Sojourn counts your days. It is not tax or legal advice, and you rely on it at your own discretion.

Where applicable law does not allow liability to be excluded in full, our total liability to you for all claims relating to the app is limited to the amount you paid us for the app in the 12 months before the claim, which is nothing if you used the app for free.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including liability for death or personal injury caused by negligence, for fraud, or for any consumer rights that cannot be waived.


8. Intellectual property

Sojourn, including its software, design, text, graphics, app icon, and the "Sojourn" and "Sojourn Atlas" names, is owned by us or our licensors and is protected by intellectual-property laws. We grant you a personal, limited, non-exclusive, non-transferable, revocable license to use the app on Apple devices you own or control, in line with the App Store Terms of Service and these Terms. We reserve all rights not expressly granted.

Your travel data is yours. Nothing in these Terms gives us any ownership of the trips, stays, passports, or other content you keep in the app.


9. Termination

You may stop using Sojourn at any time by deleting the app. You can cancel a Pro subscription as described in Section 4.

We may suspend or end your access to the app or its server-delivered features if you materially breach these Terms, if required by law, or if we discontinue the app. Provisions that by their nature should survive termination (including the disclaimer in Section 2, and Sections 6, 7, 8, 10, and 11) will continue to apply.


10. Governing law

These Terms are governed by the laws of the country in which the operator, Sacha Allard, is established, without regard to its conflict-of-laws rules. If you are a consumer, this does not deprive you of the protection of the mandatory consumer-protection laws of the country where you live, and you may have the right to bring proceedings in the courts of your home country.


11. Changes to these Terms

We may update these Terms as Sojourn evolves. When we make a material change, we will update the "Last updated" date at the top and, where appropriate, note the change in the app. If you keep using Sojourn after an update, you accept the revised Terms. If you do not agree to a change, please stop using the app.


12. Apple App Store terms

Sojourn is distributed through the Apple App Store, and Apple's Licensed Application End User License Agreement (EULA) also applies to your use of the app. Where these Terms conflict with Apple's standard EULA, Apple's EULA applies to the extent of the conflict. Apple is not a party to these Terms and is not responsible for the app or its content, but Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. Any subscription, billing, or refund question is handled by Apple as described in Section 4.
